WARRANTY AND DISCLAIMER:

 

A.        All material is guaranteed to be as specified per the contract, and all work is to be completed in a workmanlike manner according to standard practices.  Maintenance-Free Outdoor Solutions, Inc. (MFOS) is an independent contractor and its workers shall be fully covered by worker's compensation insurance.

B.        There are no warranties, expressed or implied, regarding the goods or materials used by the contractor which extend beyond the description of the face hereof.

C.        Customer shall make periodic inspections during the course of the construction and shall make final inspection with the installer at completion of the job.  Failure to make any claim for defects of any kind existing at the time of such inspection shall constitute acceptance of the labor and materials.  MFOS guarantees its workmanship for one (1) year from the completion date of the job.  Note:  This guarantee does not apply in unstable soil environments where MFOS has not control.  For example, if the fence or rail sinks noticeably because it was installed over a sink hole, or the fence or rail leans noticeably because the customer instructed MFOS to install the product in non-compacted fill dirt or near the edge of a steep hill and the ground erodes away causing structural instability to the product, these items would not be covered.  The guarantee only applies to defects resulting from normal use and not from changes caused by alteration, accident, abuse, fire, flood, or Act of God.  It should also be noted that as the moisture content of the soil changes (from saturated to dry or from dry to saturated), it is normal to have a small amount of "play" in the posts, which shall not be covered by the guarantee.
